Data Privacy

 

We can help you identify potential privacy and data protection legal issues as well as prepare data protection impact assessments and privacy policies including meeting requirements from GDPR and CCPA. Our experience includes:

  • Representing the interests of Fortune 500 companies to provide input during the drafting of GDPR.

  • Prepping companies and participating in discussions with DG Justice, France CNIL, Irish DPC, and UK ICO.

  • Addressing concerns related to cross-border data flows and data localization, providing direct feedback to U.S. government during drafting of Privacy Shield and working with several governments to increase adoption and use of APEC CBPR (Cross-Border Privacy Rules).

  • Advising privacy regulators in Japan, Vietnam, Philippines, Indonesia, Brazil, Canada, Colombia, Singapore, Thailand, and Malaysia.

  • Closely following the development and likely passage of the new CPRA (California Privacy Rights Act).


Regulatory Engagement and Compliance Strategy

 

We empower organizations to use regulations, standards development, and public policy as a way to grow markets and improve offerings. We also develop and implement plans to help organizations of all sizes with regulatory engagement, including interacting with regulators, responding to regulatory inquiries, replying to comments, and shaping policy.


AI Ethics and Machine Learning

 

We are actively tracking and influencing developments worldwide on AI Ethics and machine learning, including issues related to explainability, bias, transparency and liability. Recent work includes:

  • Leading implementation of the EU’s Ethics Guidelines for Trustworthy AI, which culminated in a full day study session with developers and researchers from the EU AI High Level Expert Group and direct improvements to the guidelines.

  • Contributing to the Singapore’s Model AI Governance Framework, which included facilitating a small group session with the PDPC and several organizations.


Blockchain, Digital Identity, Cyptocurrency

 

Our work includes regulatory engagement aimed at expanding the use cases and overall users of digital identification or eID, as well as improving the efficiency of e-verification processes. We also work on increasing legal certainty for transactions relying on information processed and verified through the use of a blockchain.


On Demand Product and Privacy Counsel

 

We offer strategic legal, business, and compliance advice, risk analysis, and due diligence at all stages of a product and service lifecycle and are available for specific one off questions or ongoing advice.


Market Expansion

 

We create engagement plans that leverage public policy and multilateral bodies to grow and access new domestic and international markets by connections to key public and private sector leaders. We have successfully built initiatives at the WTO, APEC, OECD, and at Davos with the World Economic Forum.
